Thank you for visiting the Privacy Notice of Taylor Made Golf Limited (“TaylorMade”).  TaylorMade values your privacy, and wants you to feel comfortable and secure doing business with us and using any of our websites, including: taylormadegolf.co.uk, taylormadegolf.eutaylormadegolfdirect.comtmag.biz, all other TaylorMade websites, and any TaylorMade mobile or other applications or apps, such as myroundpro.com, (the "TaylorMade Websites").  This Privacy Notice describes our practices and governs the use of personal information we collect from you or about you through the TaylorMade Websites, written or oral communications, or from other sources.  This Privacy Notice also explains the rights you have over your personal information and how you can opt out of certain uses and disclosures of your personal information, and, as a courtesy, provides a number of useful links to third party information regarding privacy protection.  However, TaylorMade does not assume any responsibility for the accuracy and/or completeness of such third party information.  If you are an individual resident in a country within the European Economic Area (“EEA”) this Privacy Notice tells you about your privacy rights and how the General Data Protection Regulations (“GDPR”) law protects you. If you are an individual resident in the United Kingdom (“UK”) this Privacy Notice tells you about your privacy rights and how the General Data Protection Regulations (“GDPR”) as incorporated into the relevant UK country law protects you.

Who We Are and Websites We Own and Operate

TaylorMade Golf is a golf equipment and accessories manufacturer and retailer with headquarters in Carlsbad, California, USA, and operations around the world, including in the United Kingdom.

This Privacy Notice applies to the TaylorMade Websites, including those operating in the European Economic Area and the UK.  Links within these sites could direct you to third party websites that are not owned or controlled by TaylorMade. TaylorMade has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites, which may employ cookies and/or collect personal information.  In addition, TaylorMade will not and cannot censor or edit the content of any third party site.  We encourage you to be aware when you leave the TaylorMade Websites, and to read the privacy notice of each website that you visit.  TaylorMade affiliates may have their own privacy notice governing websites other than the above TaylorMade Websites.

The TaylorMade Websites are owned and maintained by Taylor Made Golf Company, Inc., a Delaware, United States corporation, whose address is at 5545 Fermi Court, Carlsbad, California 92008 USA and Taylor Made Golf Limited, a company registered at the Companies Registration Office of England and Wales under the registration number 01424575, with registered office at Viables Business Park, Jays Close, Basingstoke, United Kingdom RG22 4BS, with VAT registration number GB330426006.  Taylor Made Golf Limited is registered with the UK Information Commissioner’s Office.  The registration number is Z9201387.

For the purpose of GDPR Taylor Made Golf Company, Inc and Taylor Made Golf Limited are joint controllers.

Why We Collect Information

In this Privacy Notice, “personal information” means any information that can be used to identify you.  

What personal information (Data) we collect

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data includes first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender, nationality, occupation, personal identification or passport details, golf scores, handicap and other golf-related information (such as whether you are right or left handed), golf club membership.
  • Contact Data includes billing address, delivery address, email address, telephone numbers and social media handle.
  • Financial Data includes bank account and payment card details.
  • Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us, data derived from a fitting experience which may include photographs and videos, golf product preferences, golf club fitting specifications.
  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access a TaylorMade website.
  • Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
  • Usage Data includes information about how you use our website, products and services.
  • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

and any other types of information that you choose to provide to us or that we may collect about you through other public sources, such as national and regional golf associations.

TaylorMade collects personal information because it is necessary to enable us to deliver products and services.  For example, if you order a product, we need to have information such as your billing address, product choice, delivery information, and payment processing information.  Your personal information also helps us communicate with you about our latest products, special offers, sweepstakes, and other information and events you might like to know about, if you so choose. See the section below headed “How we use the information we collect” for more information.

We also collect your personal information to help us design, deliver operation of, and tailor your experience on the TaylorMade Websites.  We may also correlate the personal information you have provided with information from other sources, which may help us to develop a more targeted user profile concerning you and/or your demographic information.  For example, if you provide us with your personal information, we may cross-check that against information that might otherwise be available through entities with whom we have business relationship in order to develop a more in-depth demographic profile of you.  We may also process personal information to target specific items of interest to you.

When you sign-up to receive marketing communications from us, we ask for your name and email address.

What Information We Collect and when

We collect information in three primary ways:

1.         You give us information:  We collect information from you when you create an account with us, sign up to receive marketing communications, purchase a product from us, or when you interact with us about a product, service, or promotion we offer.

2.         We collect information automatically:  We automatically collect certain types of personal information when you visit the TaylorMade Websites.  For example, we automatically collect various types of technical information when you use the TaylorMade Websites as described in this Privacy Notice.

3.         We collect information from other sources:  We may obtain information about you from outside sources.  For example, we may obtain commercially available information about you from third parties, such as demographic information for advertising and marketing purposes.  We may also receive information from third parties who provide third-party tracking services through web-beacons as otherwise discussed in this Privacy Notice.  These analytics providers (such as Google) or advertising networks may be based outside of the EEA.

Whenever you register a TaylorMade product, send us an email, purchase a product from a TaylorMade Website, register or create an account on one of the TaylorMade Websites, enter a contest, prize draw or competition, or other promotion, submit data through one of our applications, call our customer service department, subscribe to one of our newsletters or other marketing material or services, interact with us via a social networking service, or otherwise transmit information by giving us feedback or contacting us via post, email or any of the TaylorMade Websites or social media accounts, TaylorMade may obtain and collect your personal information, such as the following,:

  •  Identity Data such as your first and last name;
  • Contact Data such as  your postal address, telephone number, and email address;
  • Your physical traits, including handedness and handicap;
  • Your game performance data, including your golf scores, club preferences,
  • Financial Data where you purchase goods or services form us

Information We Collect Automatically

We do not automatically collect your home address, email address, telephone number, and product preferences unless you voluntarily input this information, such as when creating an account, placing an order, or inputting golf round data into an application like myroundpro.com, or when you submit questions or comments, request information, or participate in online surveys, contests, promotions or other activities.  However, as is true of most websites, the TaylorMade Websites collect certain information automatically and store it in log files by using cookies and other automated technologies when you interact with our websites.  For more information on our use of cookies, please see below in the “Cookies” Section of this Privacy Notice and in our Cookies Policy found here.

In addition to any personal information or other information that you choose to submit to the TaylorMade Websites, we and our third-party service providers (including content and analytics providers and advertising companies) may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the TaylorMade Websites or one of our advertisements or other content elsewhere online (“Usage Information”).  Usage Information may include the browser you are using, the URL that referred you to the TaylorMade Websites, all of the areas within the TaylorMade Websites that you visit, and the time of the visit, among other information.  Our systems may also automatically gather information about the search terms you use on the TaylorMade Websites and the links you select from within the TaylorMade Websites to other areas of the web or elsewhere online.  In addition, we may collect your IP address or other unique identifier of your computer, cell phone, or other device used to access the TaylorMade Websites (collectively referred to as a “Device Identifier”).  A Device Identifier is a number that is automatically assigned to your computer, your cell phone, or other device used to access the TaylorMade Websites, and our computers identify your device by its Device Identifier.  Usage Information may be non-identifying or may be associated with you and therefore identifiable.   Whenever we associate Usage Information or a Device Identifier with you, as an individual and identifiable person, we will treat it as personal information.

Disabling automated technologies

Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit.  There is no consensus among industry participants as to what “Do Not Track” means in this context.  Like many websites and online services, the TaylorMade Websites currently do not alter their practices when they receive a “Do Not Track” signal from a visitor’s browser. Preference centre: If you register an account with our website you will have access to a preference centre which will allow you modify your preferences and consents to the use of cookies and use of your information for marketing purposes. Please note you will not be able to disable necessary cookies which are required for the proper functioning of our website or used for security purposes.

Chat Rooms and Forums

The TaylorMade Websites may now or in the future include chat rooms, forums, message boards, and/or news groups. Any information that is disclosed in these areas becomes public information. You should exercise caution before disclosing your personal information via these public venues, which you do at your own risk. If you do so, you may receive unsolicited emails or "spam" from others. TaylorMade cannot safeguard the privacy of personal information that is disclosed online in this manner.

Computer Profiles

TaylorMade may also collect and accumulate other anonymous data that helps us understand and analyze the Internet experience of our visitors. For example, we may accumulate visitor data relating to referring domain names, the type of browsers used, operating system software, screen resolutions, color capabilities, browser plug-ins, language settings, cookie preferences, search engine keywords and JavaScript enablement. If you do not register on one of the TaylorMade Websites, none of this information is personally identifiable.

Children's Online Privacy Protection

TaylorMade does not knowingly collect contact or personal information from children under 13.  The TaylorMade Websites are not intended to solicit information of any kind from children under 13.  If we become aware that we have inadvertently received personal information from a child under the age of 13, we will delete such information from our records.  If you want to notify us of our receipt of information by children under 13, please do so by emailing us at ConsumerEnquiries@taylormadegolf.com.

Some countries establish the age of 16 as the threshold beyond which parental authorization for a child’s data processing is not required.  In the countries where the law imposes stricter requirements and require parental consent for children under 16 years of age for processing of their personal information we rigorously adhere to those requirements.

If you are under the age of 16, please seek the consent of your parent or legal guardian for your personal data to be used by TaylorMade for browsing the TaylorMade Websites and/or using the services they offer.  You will be able to create an account, place orders, and purchase goods and/or services on the TaylorMade Websites only if you verify your age.

Use of Cookies

Our browser software includes a feature called "cookies." If enabled, cookies may store small amounts of data on your computer about your visit to any of the TaylorMade Websites. Cookies assist us in tracking which of our features you visit most often and what content you may have viewed during past visits. When you re-visit the TaylorMade Websites, cookies can enable us to customize our content according to your preferences. We may use cookies to:

  • keep count of return visits to the TaylorMade Websites
  • accumulate and report anonymous, aggregate, statistical information on website usage

Use of Web Beacons

The TaylorMade Websites and certain emails sent to opt-in consumers contain electronic images (called "pixels", "transparent GIF files", or "web beacons") that allow us and our advertising partners to view and access cookies. In general, any electronic image viewed as part of a web page, including an ad banner, can act as a web beacon.   A web beacon is a transparent graphic image placed on a web page or in an email, which indicates that a page or email has been viewed or that an email has been forwarded.  In some cases these files are provided by our online management partner. These files enable our online management partner to recognize a unique cookie on your web browser, which in turn enables us to learn which advertisements bring users to the TaylorMade Websites. The cookie was placed by us or by another advertiser that works with our online management partner. We may also include web beacons in HTML-formatted newsletters and other emails containing graphics that we send, so we may count the number of newsletters and emails that have been opened and read.

Advertising and Online Tracking

We may also use the web beacon and cookies to monitor your online behaviour and interests on the TaylorMade Websites and communications from TaylorMade to tailor advertisements and other communications shown and sent to you to market our goods and services. With both cookies and web beacons, the information stored by the web beacon or cookie does not contain your name, address, telephone number, or email address. Our systems do not recognize browser “Do Not Track” signals, but several of our service providers who utilize these cookies and other tracking technologies on the TaylorMade Websites enable you to opt out from receiving this type of advertising. Use of IP Addresses

TaylorMade does not store or record the Internet Protocol ("IP") addresses of visitors to the TaylorMade Websites for marketing purposes, although we may store IP addresses in server logs for features such as to keep your shopping cart active, for system maintenance purposes, or to store the source location whenever someone provides Personal Information. An IP address is a number assigned to your computer whenever you access the Internet. An Internet Service Providers ("ISP") typically assigns a random IP addresses at the time of your dial-up. For local area network ("LAN"), DSL, or cable modem users, an IP address may be permanently assigned to a particular computer. We cannot determine your identity solely based upon your IP address. Your IP address can, however, reveal what geographic area you are connecting from, or which ISP you are using. Finally, other websites you visit have IP addresses, and we may collect the IP addresses of those websites and their pages, but these IP addresses are never associated with Internet users.

How We Use the Information We Collect

We will only use your personal data when the law allows us to. Most commonly TaylorMade may use your personal information in the following ways:

  • to enable us to respond to you generally, or to process, validate and verify requests and/or purchase orders and where we need to perform the contract we are about to enter into or have entered into with you
  • to perform any services requested by you
  • Where we need to comply with a legal obligation
  • to compile and/or distribute aggregate information about our website users and aggregate usage patterns
  • to provide our own website designers with useful information for improving our websites and developing new features and services that meet your needs

How We Share your Information

Retailers

TaylorMade will only disclose your email address to select third party retailers when the email is collected via a TaylorMade mobile fitting application at participating fitting locations, to TaylorMade subsidiary and affiliated companies, as otherwise disclosed in this Privacy Notice, or with your express permission.

Marketing

If you consented to use and disclosure of your personal information by TaylorMade for marketing purposes, you agree that: TaylorMade may use your personal information for marketing and survey purposes on behalf of itself and its affiliates and subsidiaries. TaylorMade appoints third party agents and suppliers in connection with such marketing and survey efforts.  TaylorMade may disclose personal information to select business partners for use in connection with direct mail marketing efforts, including, without limitation, with select third party retailers when the email is collected via a TaylorMade mobile fitting application at participating fitting locations and with TaylorMade subsidiary companies. In connection with marketing activities in particular the management of mailshots marketing emails and SMS messaging relating to, prize draws, promotions, personalised information on TaylorMade goods and services, news, offers, surveys and other marketing information which you may have agreed to receive or which may be of interest to you. TaylorMade use the following companies who provide services to TaylorMade and to whom TaylorMade will share your relevant information if you have consented to receive such marketing information:

a)         Greenroom Digital (located in the UK and Australia) to assist with collection and management of data, selection of the Winners in prize draws and the co-ordination of mail merge and marketing projects.

b)         Amazon Web Services (AWS) (located in Germany) Cloud Computing to offer reliable cloud storage

c)         Iterable (located in the US) as a marketing platform interface to manage marketing communications and as a marketing contact information database.

d)         mParticle (located in the US) as a customer data platform working as a centralised contact information database

e)         Wunderkind Corporation (Located in the US) operating a Behavioural marketing cloud platform which identifies customer purchasing likes or interests and identifies likely TaylorMade offerings which may be of interest and advises the customer of such offerings via email notifications.

We have agreements in place with such suppliers to ensure that your information is only used for the specific TaylorMade purposes specified and only on behalf of TaylorMade. Such companies (other than Wunderkind who may use your email address and cookies for the purposes stated below) are prohibited from using your information for any other purpose.

Wunderkind additional use: In connection with the provision of Wunderkind’s  consumer integrity program Wunderkind uses cookies and other pseudonymous identifiers from visitors to TaylorMade websites as well as other clients of Wunderkind’s websites to collect data of such visitors interests which may then be used to provide personalised advertising and marketing communications to such visitors relating to goods or services offered by any of Wunderkind’s clients who participate in the consumer integrity program which may be of interest to the visitor. A visitor’s cookie or other first-party ID data collected will not be accessed by or transferred to any other client of Wunderkind. Social Media advertising and look a like audiences

We shall from time to time place advertisements and promotional material on our social media channels such as Facebook, Instagram and twitter. If you have opted in to receiving marketing material from us and agreed to allow us to profile targeted advertisements via the social medial channels we may share your email address in an encrypted format with the relevant social media channel so that they can link your social media profile you have with them so that you receive such TaylorMade marketing materials posted on that social media channel. The Social media Channel will compare the email address provided by TaylorMade with information you have already provided the social media channel when you subscribed to use their services in order to link. If you are registered with the social media channel no link will be made and the email information will be deleted and not used for any other purpose. The social media channel may compare your social media profile with other users of the social media channel to establish other users who have a similar profile to enable the social media channel to target TaylorMade advertising to those other users. The Social media channel will never disclose your information to any other user without your consent, and all such use of your social media profile by the social media channel is subject to their privacy policy to which TaylorMade has no control.

Between TaylorMade group companies

TaylorMade may share your personal information and other data with businesses controlling, controlled by, or under common control with TaylorMade.  If TaylorMade is merged, acquired, or sold, or in the event of a transfer of some or all of its assets, TaylorMade may disclose or transfer your personal information and other data in connection with such transaction.  You will have the right and opportunity to object to any such transfer if, according to the applicable data protection laws, it will result in the handling of your personal information in a way that differs materially from this Privacy Notice.  The sharing of personal information with TaylorMade group companies may involve storing personal information on a group network server which may be based outside of the EEA (in particular, in the U.S.).  We ensure that we have internal data protection policies, procedures, and practices to adequately safeguard the use and security of the personal information and shall ensure it is only collected, stored, and used as described in this Privacy Notice. We have set up a data sharing and processing agreement between TaylorMade Golf Company, Inc and TaylorMade Golf Limited which complies with the requirements of GDPR and includes the EU Commission’ approved standard contractual clauses in order to safe guard your information.    

Third Party marketing

From time to time TaylorMade might establish a business relationship with other persons or entities whom it believes are trustworthy and whom it has asked to confirm that their privacy policies are consistent with TaylorMade’s and where there are adequate safeguards to protect the personal information in accordance with data protection laws.  These are known as TaylorMade’s “Select Partners.”  In such cases TaylorMade might rent, exchange, share and/or cross-reference information, including personal information about you (but only where we have received your express opt in consent), that will enable such persons or entities to contact you regarding products and services that may be of interest to you.  Once you’ve opted-in, you have the right to opt-out of data sharing with Select Partners as described in the “Personal Information Maintenance & Opt-Out” Section below.

If you have exercised your "opt-out", TaylorMade will use or disclose your personal information only as stated above, or: (1) when legally ordered to do so by a lawful subpoena or court order, (2) if you violate or breach an agreement with TaylorMade and TaylorMade seeks legal redress, (3) if we believe you will harm the property or rights of TaylorMade or those of TaylorMade's other customers, (4) under exigent circumstances to protect the physical safety of TaylorMade, its employees, users or the general public, or (5) to validate credit card numbers for charging for fee services where relevant, (6) where we have some other legal obligation to process your personal information, or (7) in connection with any relevant contract we have with you.

Aggregate Information

TaylorMade may share aggregate statistical information with business partners, sponsors or other third parties. For example, we may tell an advertiser that X number of visitors visited a certain area on the TaylorMade Websites, or that Y number of men and Z number of women filled out registration forms.  Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity therefore such information will not be treated as personal information. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

Unsolicited Emails Received by You

TaylorMade does not send unsolicited bulk emails to anyone who has requested that we do not contact them. We send our newsletters only to those who have subscribed to receive them. If you have inadvertently received one of our newsletters or other marketing communication, or if you simply wish to stop receiving them, please follow the "unsubscribe" instructions contained in each newsletter or send a request to be unsubscribed to ConsumerEnquiries@taylormadegolf.com or where available use the preference centre (please see the section below headed “Personal Information Maintenance & Opt-Out”).

TaylorMade Text Message Programs

Your Rights & Choices About the Information We Collect

It is important that you are able to control your personal information.  We are committed to providing you with control over your personal information.  To the extent allowed by applicable law, you have the following rights with respect to your personal information:

  • Right of Access, which means your right to confirm whether we maintain any personal information concerning you in our systems and databases, what categories of personal information we store and use, purposes and legal bases of processing of your personal information, recipients, retention periods, cross-border transfers, technical and organizational measures we implement to secure privacy of your information;
  • Right to Data Portability, which means your right to receive a copy of personal information that you provided to us to be sent to you or a third party in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.;
  • Right to Rectification, which means your right to request an amendment or update to any inaccurate or incomplete personal information that we maintain about you in our systems and databases although we may need to verify the accuracy of the new data you provide to us;
  • Right to Restrict Processing, which means your right to request restrictions on how we use and process your personal information if you believe that TaylorMade does not have legal bases to process your personal information or your personal information is inaccurate;
  • Right to Withdraw Consent, which means your right to revoke authorizations given to us on how to use and share your personal information, including disclosing your information to third-part recipients;
  • Right to Object, which means your right to object to using your personal information for certain purposes, including direct marketing and profiling; and
  • Right To Be Forgotten, which means your right to request us to delete your personal information from our systems and databases where there is no good reason for us continuing to process it. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Please be aware that it is not always possible to completely delete, erase, or comply with your request with respect to all of your personal information from or in our systems and databases without some residual data backups because we still need to process your personal information for the purpose the data was originally collected, or we need your information to comply with legal obligations, perform contracts, resolve disputes, and for other legitimate reasons.  We are also unable to delete your transactional data related to your purchases and returns because we need to keep these records as long as required by the applicable law.  If we are precluded from honouring your request for erasure of your personal information, we will inform you of the reasons for the rejection.  We will process all the requests within one month of receipt or within such other time as specified by applicable law. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.  Please submit your requests to ConsumerEnquiries@taylormadegolf.com. For verification purposes and to protect your confidentiality, we can only respond to the requests sent from an email address that you provided to us or used when registering an account on the TaylorMade Websites.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights).  This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it.  We may also contact you to ask you for further information in relation to your request to speed up our response.  Occasionally, it may take us longer than 30 days to deal with your request if your request is particularly complex or you have made a number of requests.  In this case. We will notify you and keep you updated.

Personal Information Maintenance & Opt-Out

You have the right to object to processing of your personal information for marketing purposes, commonly known as opt-out requests.  If you wish to opt-out of our use and/or disclosure of your personal information, other than to process any purchase orders and communicate with you about your account, you will have the option to do so when you first submit your personal information via the TaylorMade Websites and at any time thereafter.   You are opting into receiving marketing communications from TaylorMade if you check the box stating that you want to receive emails or marketing communications from TaylorMade Golf, and you are opting out if you leave the box unchecked.  At any time thereafter, if you wish to opt-out or if you wish to amend or delete any personal information you have previously provided without opting-out, please send us a message at ConsumerEnquiries@taylormadegolf.com.

We will endeavour to provide a simple way to review, correct, update or remove personal information you have given us.  If you wish to stop receiving a TaylorMade newsletter that you have previously subscribed for or any other marketing communications, please follow the "unsubscribe" instructions contained at the bottom of each newsletter or email.

If you have registered with the TaylorMade website and have a log in account you can manage your marketing preferences by visiting the preference centre on our website. Here you can change your marketing preferences and cookies consent by either opting in or opting out.

Retention of Your Personal Information

Your personal information may be retained by TaylorMade for as long as the purposes for which the personal information was collected continue and require so, or if the retention is necessary for our legal or business purposes including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements.  For example, we are required to keep your basic personal information (name, address, and contact details and any transactional details) under UK tax law for six years.  Also, we may need to retain your personal information if we need to defend a legal claim or in case of a dispute.  In addition, we retain the right to keep non-identifiable information related to your game performance, use of TaylorMade products and/or applications for research and development purposes to improve our products and your user experience.  We will keep your personal information shared by you for direct marketing purposes until you notify us (by opting out) that you no longer wish to receive marketing materials from us.

International Transfers of Personal Information

When visiting the TaylorMade Websites your connection will be through and to servers located in the United Kingdom and the United States.  All information you receive from us will be created on servers located in the United Kingdom and the United States, and all information you provide will be maintained on web servers and systems located in the United Kingdom and the United States.  By using the TaylorMade Websites and/or submitting information to us, your information will be stored and processed using the facilities and servers in the United Kingdom and the United States, and to those with whom we may share your information, to the extent allowable by law.  Where legally allowed only with your explicit consent, we will affirmatively ask you for your consent

TaylorMade has its headquarters in the United States.  Information we collect from you will be transferred and processed in the United States and the United Kingdom.  By using the TaylorMade Websites or providing us with any information such information may be shared transferred and processed between the United States and UK and other locations within the EEA as may be necessary to fulfil the purposes for which the information has been provided and where it is lawful to do so.   Where legally allowed only with your explicit consent, we will affirmatively ask you for your consent.  The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR (the EU General Data Protection Regulation 2016/679) however the UK has received a finding of adequacy.  When transferring your personal information outside of the country of collection for the purposes stated therein, TaylorMade complies with the applicable laws.  For the data transfer outside the European Economic Area, and UK.

For transfers of data within the TaylorMade group, TaylorMade uses standard contractual clauses adopted by the European Commission and UK.  For the purposes of onward personal data transfers outside the European Economic Area within the TaylorMade group of companies, TaylorMade companies entered into a Data Transfer Agreement encompassing standard contractual clauses.

We also use third parties to assist with the storage and processing of the data , for example to store data on severs dedicated for TaylorMade use, or for processing  marketing material on behalf of TaylorMade, such as mail shots and other promotional activities, maintenance of marketing databases.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Whenever we transfer your personal data out of the EEA or UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
  • Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK or where the service providers have agreed to comply with standard contractual clauses or other EEA recognised and approved safeguards are in place.

Security

The TaylorMade Websites use physical, electronic and managerial security measures to protect the loss, misuse and alteration of information under our control.

  • We use Secure Socket Layer ("SSL") connections with 128-bit encryption for certain transactions and confidential data. When you use a secure browser, all information you submit comes to us over the Internet in an encrypted form. Every secure page uses a digital certificate issued by a third-party certification authority. A "site certificate" sits on all secure pages.   • We monitor system and application activity logs to identify any unusual activity from authorized and/or unauthorized individuals accessing our systems and/or making changes to stored information. We regularly perform preventative system maintenance and monitoring to ensure the security of our data systems.
  • We maintain our servers in locked facilities with secure and restricted access. Backup tapes are retrieved daily and stored by an independent company in a secure, off-site location.

The TaylorMade Websites do not require you to set up a user ID and password unless you subscribe for some of our special services or create a purchasing account with us. We recommend you do not divulge your password to anyone. TaylorMade will never ask you for your password in an unsolicited telephone call or email.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit, and you do so at your own risk. You can report network abuse and any risk of security violations to us by emailing ConsumerEnquiries@taylormadegolf.com.

Complaints

In the European Economic Area and UK, you have the right to lodge a complaint, if you believe your rights have been breached, to your local supervisory authority for data protection matters (you can check which your local national supervisory authority is here https://edpb.europa.eu/about-edpb/about-edpb/members_en). In the UK this is the Information Commissioner’s Office via its website at https://ico.org.uk/concerns/ or you can seek a remedy through local courts if you believe your rights have been breached. We would, however, appreciate the chance to deal with your concerns before you approach the supervisory authority so please contact us in the first instance.

Questions & Changes in Policy

We reserve the right to change or amend this Privacy Notice at any time, without notice to you, in which case we will post the amended Privacy Notice on our website.  We may email you to notify you about the material changes thereto, but you should check our website to see the current Privacy Notice in effect.
